TERMS OF SERVICE

1. Acceptance of Terms
By accessing or using OPSCOM ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
2. Eligibility

General users must be at least 13 years of age to create an account and use the Platform.

Community owners (those who create and manage a community on the Platform) must be of legal age to enter into a binding contract in their jurisdiction. By subscribing, you represent that you meet this requirement and are authorized to use the payment method provided.

3. Description of Service
OPSCOM is an online platform providing community management tools for military simulation (milsim) groups and organizations. Features include member administration, rank management, unit structure, operations planning, training tracking, and Discord integration. Access to community creation and ownership is provided via a paid subscription.
4. Subscriptions & Billing

Creating and owning a community on OPSCOM requires an active paid subscription.

  • Subscriptions are billed on a monthly basis.
  • Payment is processed securely through Stripe. By subscribing, you also agree to Stripe's Terms of Service.
  • No refunds are issued for any subscription payments, partial periods, or unused time.
  • If a payment fails, a grace period of 7 days applies before the community is suspended. You will retain the ability to resolve the payment within this window.
  • Upon cancellation, your subscription and community access remain active until the end of the current billing period, after which the community is suspended.
5. Free Trial
New subscribers receive a 14-day free trial. No charges are applied during the trial period. If you cancel before the trial ends, you will not be charged. After the trial period, your subscription converts to a paid monthly plan automatically.
6. Community Suspension & Termination

A community may be suspended or permanently terminated under the following circumstances:

  • Non-payment following the 7-day grace period
  • Violation of these Terms
  • Receipt of a credible report of prohibited activity occurring within the community
  • Discovery by OPSCOM of conduct that violates these Terms

Suspension due to non-payment is reversible by resolving the outstanding payment. Termination for Terms violations is at OPSCOM's sole discretion and may be permanent.

7. Acceptable Use

You agree not to use the Platform to engage in any of the following:

  • Harassment or targeted abuse of other users
  • Doxxing — publishing private personal information of any individual without their consent
  • Hate speech — including extreme racism, antisemitism, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin, or affiliation with real-world hate movements
  • Child sexual abuse material (CSAM) — any such content will result in immediate permanent account termination and will be reported to the relevant authorities
  • Exploiting vulnerabilities — using bugs, exploits, or unauthorized methods to access, manipulate, or disrupt the Platform or other users' data
  • Impersonating OPSCOM staff or misrepresenting an official affiliation with OPSCOM
  • Distributing malware or conducting phishing — using the Platform to deliver malicious software or deceive users into disclosing credentials or personal information
  • Payment fraud or chargeback abuse — including intentional chargebacks for services rendered
  • Ban evasion — creating a new account after receiving a platform ban
8. Real-World Use
OPSCOM may be used by real-world organizations for administrative and organizational purposes. However, OPSCOM explicitly does not condone the use of the Platform to plan, coordinate, or incite illegal activities, civil unrest, or harm toward real persons or authorities. Any such use constitutes a violation of these Terms and is grounds for immediate and permanent termination.
9. Community Owner Responsibilities
Community owners are solely responsible for the content, conduct, and moderation within their communities. OPSCOM does not actively monitor community content. However, if prohibited activity is reported to us or discovered, the community may be suspended or permanently terminated at OPSCOM's discretion.

OPSCOM is not liable for any content, actions, or decisions made within individual communities.

10. User Content

You retain full ownership of any content you upload to the Platform, including logos, images, documents, and other materials ("User Content"). By uploading User Content, you grant OPSCOM a limited, non-exclusive license to host and display that content solely for the purpose of providing the Platform's services.

Upon account or community deletion, all associated User Content is permanently and immediately deleted from our systems. This action is irreversible.
11. Privacy & Data

OPSCOM collects and processes personal data necessary to provide the Platform, including your Discord account information (username, avatar, Discord user ID) obtained via Discord OAuth login, and payment information processed by Stripe.

We do not sell your personal data to third parties. Data is used solely to operate and improve the Platform.

Upon deletion of your account or community, all associated personal data is permanently deleted from our systems.

OPSCOM complies with applicable Dutch and EU data protection law, including the General Data Protection Regulation (GDPR). A full Privacy Policy will be published separately.
12. Third-Party Services

OPSCOM integrates with Discord for authentication and community features. OPSCOM is not affiliated with, endorsed by, or responsible for Discord or its services. We are not liable for any disruptions, API changes, or policy changes made by Discord that affect the functionality of the Platform.

Payment processing is handled by Stripe. OPSCOM does not store or have access to your full payment details.
13. Intellectual Property
All Platform software, design, branding, and content created by OPSCOM — including the OPSCOM name and logo — are the property of OPSCOM and may not be reproduced, copied, or redistributed without written permission.
14. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind, express or implied. OPSCOM does not guarantee uninterrupted or error-free service.

To the fullest extent permitted by applicable law, OPSCOM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of data, loss of revenue, or disruption of community operations.
15. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
16. Changes to Terms
OPSCOM reserves the right to update these Terms at any time. We will notify users of material changes via the Platform or by email where possible. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
